General Terms and Conditions Noordkade Uitjes

Article 1 Applicability 

1.1 Noordkade Uitjes uses house rules and game rules. These can be found on this website. By placing a reservation, the visitor declares that he is familiar with and agrees to the house and game rules.  

1.2 Noordkade Uitjes can change these general terms and conditions in whole or in part at any time. Participants will be informed of the changes in good time. If the visitor does not agree with the change (s), Noordkade Uitjes must inform Noordkade Uitjes in writing within ten working days, calculated from the day after the change of the general terms and conditions. In that case, the organization will make every effort to find a suitable solution.  

1.3 The nullity of any provision of these general terms and conditions does not affect the validity of the other provisions  

Article 2 Access  

2.1 An order placed is irrevocable and the visitor cannot change the agreement after that moment. Noordkade Uitjes reserves the right at all times to refuse orders or to set additional conditions. 

2.2 Information, such as announcements and quotations, regarding a reservation will be displayed or provided as accurately as possible. Additional costs may be charged for additional costs of, for example, reservation, payment, or arrangements. Noordkade Uitjes accepts no liability for any inaccuracies or incompleteness in the price information provided.  

2.3 Reservations are only possible online via www.noordkadeuitjes.nl. If you have any questions about this or if you need help, we would be happy to help you via +31 413 - 78 22 50 or by e-mail: info@noordkade-uitjes.nl.  

2.4 After making a reservation you will receive a confirmation email. This contains all the details of your reservation including information about the location. Such as our free parking spaces. Please note, this confirmation email may end up in your spam folder. If you have not received a confirmation email, the reservation is not final. In that case, we would like to ask you to contact us by telephone at +31 413 - 78 22 50.  

Article 2a Contests  

1.0 Won vouchers can only be used for activities of Noordkade Uitjes, found on the website under 'Noordkade Uitjes activiteiten'. 
1.1 Participation to our contests are free. Each contestant can only take part once per contest.
1.2 There is no minimum age to our contests, unless noted.
1.3  The winners will be announced via Facebook/Instagram. 
1.4 The winner will receive a voucher via the e-mailadress known to us.
1.5 Personal data will be kept secret conforming the AVG. Noordkade Uitjes has the right to use the data in the e-mail as long as the guest does not retrieve.
1.6 There cannot be corresponded about the results of the contest and the price.
1.7 Participants who do not comply with these rules can be excluded from taking part in the contest.

Article 3 Cancellation or transfer  

3.1 Cancellation free of charge is possible up to 96 hours before the start of your reservation and up to 20 people, after that 50% will be charged. Cancellation is only possible by emailing info@noordkade-uitjes.nl. You will always receive a cancellation 
confirmation. For groups of 20 people or more, cancellation is free of charge only up to 30 days before the start, after which 50% of the total offer will be charged. With cancellation within 96 days of the activity, we will charge the full 100%.  All costs incurred with third parties will be passed on one on one.  
The number of participants may be adjusted up to 24 hours before the start, up to a maximum of 10% of the reservation. The quantities will be invoiced within 24 hours based on the reservation made. This applies to the catering industry, external parties and Noordkade Uitjes.

3.1a For the Sim Racing Veghel activity, 50% cancellation costs will be charged as soon as fewer guests participate in the activity than previously reserved.

3.2 In case of force majeure, Noordkade Uitjes can cancel the reservation or move it to another date. 'Force Majeure' should be interpreted broadly in that context and includes serious illness and/or cancellation of the supervision, strikes, fire, bad weather conditions, renovations, etcetera. Noordkade Uitjes has the option to cancel or change the reservation up to 24 hours before the start. In case of cancellation on our part, the entire amount will be refunded within 10 working days.  

3.3 If the actual participant numbers deviate from the reservation by more than 10%, Noordkade Uitjes will charge a cancellation fee. The cancellation fee is based on the number of participants and x% of the price per person.

Article 4 Liability  

4.1 Participation is at your own risk. Noordkade Uitjes is not liable for any damage, material or immaterial, that the participant may suffer as a result of participation. Noordkade Uitjes is not liable for loss, theft, or damage to property.

4.2 If despite the provisions of the first paragraph of this article, the liability of the organization for damage to the participant must be assumed, the obligation of the organization to compensate that damage remains limited to a maximum of the amount that the insurer of the organization has of that damage.  

4.3 The participant declares that he/she is aware of the fact that participation in the event requires good health in both psychological and physical sense, and declares that he meets this requirement and that he/she has sufficiently prepared for the mission. The activities at Noordkade Uitjes offer a real-life experience with an exciting ambiance and can be experienced as scary by some people. However, no situations will arise where you are actually in danger.  

4.4 The Visitor indemnifies Noordkade Uitjes against liability for damage that third parties may suffer as a result of an act or omission attributable to a participant concerning the event. 

4.5 The Visitor indemnifies Noordkade Uitjes against liability for damage that a third party may suffer at the hands of the participant during his participation in the event.  

Article 5 Birthday parties  

5.1 We have different minimum ages per activity.

5.2 When making a reservation for a birthday party, the entire group needs to consist of children, with a maximum age of 15 years. 

5.3 Different prizes for birthday parties are only available on weekdays till 5 o'clock.  

5.4 Birthday parties in one of our escaperooms are always under supervision by one of our employees.

5.4.1. If an adult wants to supervise themselves and is actively involved in the activity, Noordkade Uitjes has the right to charge full adult fees for that person. 

Article 6 House rules  

6.1 Participants must comply with the house rules and the regulations and instructions of the organization and competent authorities. If the organization considers this reasonably necessary to maintain peace and order during the mission, in any case, if order or safety is endangered during the mission, it has the right to deny the visitor (further) access to the mission and from Noordkade Uitjes.  

6.2 Children under the age of 15 are only admitted when accompanied by adults.

6.3 To enable the organization to comply with its legal obligations, participants must be able to identify themselves upon request. If the participant is unable to do so, participation in the mission can be denied.  

6.5 Digital cameras, (digital) video cameras/camcorders, and other (sound) recording equipment are not allowed. Telephones must be stored in the lockers in the reception area designated by the organization.

6.6 Registration of the event in any form whatsoever without the explicit prior written permission of the organization, including professional photography, filming, and making sound and/or video recordings for commercial purposes, is prohibited, as is an emphasis of and/or takeover. from the program (booklet), posters, or other printed matter.  

6.7 Furthermore, the following items are not permitted during the activity: food, glassware, plastic bottles, water bottles, cans, camel bags, pets, (folding) chairs, stools, inflatable objects, umbrellas and parasols, selfie sticks, drugs, fireworks, (fire) weapons and dangerous objects. The organization will confiscate unauthorized items or have them seized at the entrance. Legal valuables can be retrieved later. Illegal items will be handed over to the police.  

6.8 Smoking is not allowed. Any fines imposed on the organization as a result of the visitor's violation will be recovered from the visitor.  

6.9 The use of alcohol and/or drugs is prohibited during the game. If an employee of Noordkade Uitjes has doubts about the condition of the participant, the employee has the right to refuse this participant without a refund. 6.9a If during the game decoration, game elements or other properties of Noordkade Uitjes are destroyed or soiled, costs will be charged for this. 

6.10 It is not allowed to bring pets or other animals with you during the mission. It is also not allowed to crowd surf, make fire (small) and/or perform commercial activities on the site, and/or to express yourself in any way offensive, discriminating or insulting or to wear or distribute such signs. .  

6.11 The fun of this escape mission includes solving the riddles. Give your friends this pleasure too and tell them about your experience, but don't reveal the secrets. Consider yourself bound by confidentiality.  

6.12 Vouchers, also called promotional vouchers, may be refused if we question their authenticity. The vouchers are also only valid for our services; drinks and snacks are excluded.  

6.13 Gift cars, vouchers of promotional vouchers are there for different amounts. It is not possible to combine multiple gift cards or vouchers in one reservation.

Article 7 Privacy and personal data  

7.1 By agreeing with the organization, (personal) data of the visitor can be collected, recorded, and stored in a data file.  

7.1a The (personal)data can be used to send promotions, newsletters or other advertising from Noordkade Uitjes by email, post or (Whatsapp) messages.

7.2 The organization handles the (personal) data obtained with due care and processes them exclusively following the Personal Data Protection Act.

7.3 By agreeing with the organization, the participant gives explicit permission for the processing of (personal) data.  

7.4 The organization may use the participant's data to optimize its services and marketing for the event and future events.  

7.5 Visual and/or sound recordings may be made of the event and the participants and recordings will be made public or reproduced. The visitor unconditionally grants permission for the aforementioned recordings to be made and their exploitation without the organization or third parties owing or paying compensation to the visitor. Any neighboring and/or copyright and/or portrait rights are hereby transferred by the visitor to the organization without any restriction. Furthermore, the visitor irrevocably waives the right to invoke his / her personality rights.  

7.6 During the mission (image) recordings are made with security cameras, the organization can hand these over to third parties, including the police and the judiciary in the event of calamities.  

Article 8 Invoice  

8.1 The Space B.V. charges administrational fees when we need extra data from the Visitor to pay an invoice, starting from €50,00 euros excluding 21% VAT. Think of putting in invoices in an online software package for which you need an account, documents that need to be printed and filled in or other administrative actions needed to pay the invoice.

8.2 If the Visitor fills in these information themselves, the administrational costs will be dropped.

Article 9 Final provisions  

9.1 These general terms and conditions are exclusively governed by Dutch law.  

9.2 These General Terms and Conditions are only applicable on The Space B.V. and are not part of the General Terms and Conditions of partners, like restaurants and other leisure, at the Noordkade. The Space B.V. will bring any disputes between customer and partners into direct contact with each other. Costs incurred from third parties cannot be recovered from The Space B.V.

9.3 Any disputes, of whatever nature, that arise between a visitor and the organization as a result of (use or application of) these general terms and conditions and/or related agreements, will first be submitted to the competent court in 's-Hertogenbosch.
